Margaret Nyakang’o, the Controller of Budget (COB), has rejected a request to prevent Meru County Governor Kawira Mwangaza from accessing funds from the County Revenue Fund.
Meru Senator Kathuri Murungi had sought to block Mwangaza’s withdrawals while her impeachment process is ongoing.
Nyakang’o, however, denied the request, citing that the High Court has temporarily suspended Mwangaza’s removal.
This suspension follows Mwangaza’s challenge to the legality and procedures of the Senate’s impeachment vote.
Nyakang’o emphasized that Mwangaza remains the duly elected governor until the court issues further instructions.
She explained that under the County Governments Act, Mwangaza retains the authority to approve the Appropriation Bill.
“Therefore, given the court’s orders and the Appropriations Act being enacted, we are unable to comply with the request to stop withdrawals from the Meru County Revenue Fund,” Nyakang’o stated.
Mwangaza recently faced her third impeachment attempt on August 21. During a contentious Senate session, all three charges against her were confirmed.
The Senate found her guilty on the first charge of gross constitutional and legal violations, with 26 votes in favor, 4 against, and 14 abstentions.
The second charge saw a similar outcome, with 26 Senators in favor, 2 opposed, and 14 abstaining. On the third charge of abuse of office, 27 Senators voted to confirm it, 1 voted against, and 14 abstained.
The High Court has put a hold on her removal, with a hearing scheduled for September 17, 2024, to review the case’s compliance and to set a date for reviewing written submissions.
