In a recent legal development, a caretaker employed by Kaggs Investment Limited, responsible for managing a portfolio of over 1000 rental properties across Nairobi County, has been formally accused of embezzling Sh663,000 in rent.
The accused, entrusted with the task of collecting monthly rent payments from tenants residing in Kaggs Investment Limited properties, stood before Chief Magistrate Susan Shitubi at the Milimani Law Courts to face the charges leveled against him.
The alleged offense, as per court records, transpired between January 28, 2017, and June 14, 2020. Despite the severity of the accusations, the accused denied any wrongdoing.
Prosecution counsel Nyakera Kibera elaborated on the allegations, asserting that the caretaker illicitly pocketed funds collected from tenants as part of their monthly rental obligations.
According to the prosecution, Kaggs Investment Limited boasts a substantial property portfolio spanning multiple estates, including Eastleigh, Mlango Kubwa, Ngara, Kariobangi South, Thika Road, and Mombasa Road within Nairobi County.
In the courtroom, it was revealed that the accused had failed to remit the collected rent money to the company, as required by their employment responsibilities.
In an attempt to secure release from custody, the accused’s defense attorney cited a prior bond granted in a similar case involving Kaggs Investment Limited as the aggrieved party.
Highlighting this precedent, the defense sought a reasonable bond arrangement, emphasizing the shared complainant between the two cases.
Chief Magistrate Shitubi took note of this assertion and subsequently granted the accused conditional release.
The accused was released on a Sh100,000 bond, with a surety of similar value, or an alternative cash bail of Sh60,000.
The legal proceedings are slated for further discussion during a pre-trial hearing scheduled for May 7, 2023, where additional directives will be issued regarding the case’s progression.
