A Nairobi court has ordered the release of activist Boniface Mwangi and four other individuals who had been detained during a demonstration on July 25, 2024.
The release follows their initial appearance in court on July 26, 2024, where they were granted bail.
The individuals in question Boniface Mwangi, Albert Wambugu, Robert Otieno, Pablo Chacha, and Erot Franco faced a range of charges including the publication of false information, unlawful assembly, and creating a disturbance.
The charges stem from their involvement in a march aimed at honoring victims of the ongoing anti-government protests.
On Tuesday, the court made a significant decision by rejecting the prosecution’s request for an additional two weeks to finalize their investigation into the five suspects.
This request was made in an effort to gather more evidence before proceeding further with the case.
However, the court’s denial of this request means that the case will not be delayed any further.
Additionally, the court ordered the return of the cash bail previously posted by the defendants, thus concluding their temporary financial obligations related to the case.
The decision marks a pivotal moment in the legal proceedings against Mwangi and his associates.
The court’s move to release the suspects and deny the extension request reflects a swift judicial response, ensuring that the accused will not remain in custody longer than necessary without further substantiation of the prosecution’s claims.
Mwangi and his co-defendants had been arrested during a demonstration intended to commemorate individuals affected by the protests, highlighting their commitment to social and political causes.
The court’s decision to release them, while also addressing the prosecution’s request for an investigation extension, underscores the ongoing legal and social dynamics surrounding anti-government activities in the country.
