

Embakasi East MP Babu Owino was Tuesday acquitted in a criminal case where he was charged with behaving disorderly at B Club, Nairobi where DJ Felix Orinda is said to have been shot.
The trial court found and held that the prosecution didn’t adduce sufficient evidence to convict the MP.
Senior principal magistrate Bernard Ochoi said the prosecution failed to record even a statement of the victim, the ballistic evidence produced in court was scanty and the same could not be relied upon to find the MP guilty.
He said that the prosecution failed to convince the court that the MP was involved in the shooting.
The prosecution didn’t produce a medical report as regards samples and swaps that were taken at the scene on 17/04/2020 when the incident occurred.
The magistrate pointed out that even the ballistic expert admitted in his evidence that the bullet and the cartridge that was recovered at the scene did not match.
He said that the defense counsels representing the MP senior counsel Elijah Ongoya, Dancan Okatch, and Ndegwa Njiru had pointed out during the trial that the prosecution didn’t have sufficient evidence to sustain the criminal charge.
Owino promised to walk by Orinda aka DJ Evolve in his journey to recovery.

Speaking at Milimani Law Courts after he was acquitted on the charges of misuse of a firearm on Tuesday, Owino said he was planning on paying for the DJ’s further treatment overseas.
“I will walk by DJ Evolve. I will always be there for him.
I’m planning to take him to India for further treatment,” he said.
The MP further said he hoped that the DJ recovered fully, saying he would count it as a victory to see him well.
“I pray to the Almighty God to grant him spiritual and physical strength,” he added.
Owino has been paying for DJ Evolve’s hospital bills and other bills, using more than Sh58.6 million.
DJ Evolve was injured in a shooting incident at a Nairobi club on January 17, 2020.
