The High Court recently threw out a case questioning the enactment of the Affordable Housing Bill 2023.
In this legal challenge, Lawrence Opiuo, an activist from Kisumu, argued that the National Assembly had rushed the passing of the Affordable Housing Act without the proper involvement of the public.

The court, however, observed that public discussions and consultations with relevant parties had already taken place by January 30.
Consequently, it declined to intervene in the legislative process.
According to Justice Mwanaisha Shariff, the National Assembly’s handling of public participation in the bill was deemed appropriate.
“The court acknowledges that the National Assembly’s engagement with the public was satisfactory and in accordance with the necessary requirements,” the judge remarked.
