The High Court is set to provide updates today regarding a case brought by the family of missing Wajir MCA Yussuf Hussein, who is seeking his appearance in court.
The family is requesting that the Inspector General of Police (IG) and the Directorate of Criminal Investigations (DCI) be compelled to produce him.
Justice Alexander Muteti is expected to issue further instructions following a previous directive for the state to present Yussuf if he is indeed in their custody.
Represented by advocates Danstan Omari and Abdikadir Ahmed, who filed the lawsuit on Yussuf’s behalf, the family alleges that he has been missing since the night of September 13, 2024.
Ahmed claims that Yussuf was forcibly taken from a taxi he had ordered from South B estate around 8 PM on that date.
“The circumstances of his disappearance are concerning, and there is a reasonable fear that he may have been abducted by officers from the IG and DCI,” Ahmed stated.
He further noted that the authorities have denied the family access to Yussuf while also refusing to bring him before a court to face any charges.
Despite two occurrence books (OBs) being filed regarding his disappearance, no one has accounted for Yussuf’s whereabouts.
The taxi driver involved has provided an affidavit, indicating he reported the incident and obtained an OB detailing what transpired that evening.
Ahmed mentioned that the family visited Makadara Police Station, where they were informed that Yussuf’s phone was in police custody, as reported by the taxi driver.
“Without intervention from this court to compel the respondents to produce Yussuf, we will continue to endure the anxiety and distress caused by his forced disappearance,” the family’s documents state.
