The Judicial Service Commission (JSC) has revealed it is currently reviewing five petitions and complaints filed against several judges of the Supreme Court and High Court, including Chief Justice Martha Koome.
In a statement released Thursday, JSC Vice Chairperson Isaac Rutto confirmed that advocate Nelson Havi had submitted a petition on January 10, accusing Koome, Deputy Chief Justice Philomena Mwilu, Justices Njoki Ndung’u, Mohammed Ibrahim, Dr. Smokin Wanjala, Isaac Lenaola, and William Ouko of gross misconduct and misbehaviour.
“Since the start of 2025, the JSC has received five petitions or complaints concerning judges,” the statement said.
“One of these, filed by Mr. Nelson Havi on January 10, 2025, pertains to allegations against the seven Supreme Court judges, which we acknowledge receiving on January 13.”
Should the JSC find merit in the petition, it could recommend to the president the formation of a tribunal for their potential removal from office.
Rutto also confirmed that two separate petitions had been filed against High Court Justice Alfred Mabeya, alleging misconduct and misbehaviour.
These complaints were lodged by Havi and Cytonn CEO Edwin Dande.
“The Commission has received two separate petitions regarding Justice Alfred Mabeya of the High Court: one from Mr. Nelson Havi, dated January 10, 2025, and received on January 13, and another from Mr. Edwin Dande, dated December 16, 2024, and received December 18,” Rutto said.
Additionally, Havi has filed a petition against Justice Lucas Leperes Naikuni, also of the High Court, alleging incompetence in judicial duties.
Rutto reassured that the JSC would follow its established procedures for handling such complaints, emphasizing adherence to the Constitution, the Judicial Service Act, and international best practices.
“The complaints will be processed in full compliance with the law, including the Fair Administrative Action Act,” Rutto stated.
“The JSC remains committed to safeguarding the judiciary’s independence while ensuring accountability.”
The JSC has processed 935 petitions against judges from 2011 to 2024, with 862 resolved and 12 forwarded to the President with recommendations for tribunals.
The remaining 73 are in various stages of review.
