The Kenya Revenue Authority (KRA) has provided further details on the implementation of the Device Control Touchpoint, a key component of its Enterprise API Integration (EAPI) project, which focuses on mobile devices.
In a recent press statement, KRA explained that the initiative is aimed at ensuring proper tax declaration, payment, and verification for mobile devices imported into or assembled in Kenya.
The system will use International Mobile Equipment Identity (IMEI) numbers to effectively monitor and track mobile devices within the local network.
The KRA clarified that the tax requirements will apply to all mobile devices used within Kenya.
However, the new rules will not apply to foreign visitors in Kenya for short stays.
Additionally, Kenyans returning from abroad with mobile devices valued below $2,000 (approximately Ksh 257,994) will be exempt from taxation.
“For personal use, we will allow a mobile device as part of accompanying baggage, as long as the quantity does not suggest a commercial intent.
The total value of all items in the baggage, including mobile phones, should not exceed $2,000,” KRA stated.
The Authority emphasized that this move is part of a broader effort to combat smuggling and the importation of counterfeit mobile devices.
It also noted that the process for declaring mobile devices on the F88 form is being automated, meaning passengers will no longer need to declare their devices when exiting the country.
Tourists and short-term visitors will not be impacted by these new requirements, KRA clarified.
The initiative is being implemented in collaboration with the Communications Authority of Kenya (CA), which is responsible for regulating the communications sector, while KRA focuses on tax collection and enforcement.
“KRA works closely with other regulatory bodies to ensure compliance with both tax laws and product standards,” the Authority explained.
“This initiative brings together regulatory oversight from CA and KRA’s tax enforcement to improve compliance and prevent tax evasion.”
KRA stressed that the registration of IMEI numbers is a vital step in ensuring mobile devices are tax-compliant.
The Communications Authority has mandated IMEI registration as a control measure to protect Kenyan consumers from counterfeit products, fraud, and smuggling.
“By registering IMEI numbers, we can verify that mobile devices in use are legitimate and have met the necessary tax obligations,” KRA concluded.
