The High Court has decided to exclude the late Education Cabinet Secretary Prof. George Magoha from the ongoing Competency-Based Curriculum (CBC) case.
This development occurred following a request made by lawyer Nelson Havi, who is actively opposing the new curriculum.
The court approved the application for Magoha’s withdrawal from the case.
Initially listed as the 8th respondent, Magoha had already submitted responses and arguments through his legal representatives, Phiilip Murgor and George Ouma.

In the meantime, the Attorney General has been granted a seven-day period to submit the CBC Taskforce Report to the respondents.
Additionally, a court appearance on February 15 has been scheduled for further directions.
Nelson Havi’s case challenges the constitutionality of the CBC curriculum, asserting that its introduction lacked proper preparation and consultation.
The petitioner contends that the implementation of CBC poses a threat to children’s futures due to inadequate readiness on the part of the teachers.
