Three petitioners have initiated a legal challenge to prevent the Senate from proceeding with the impeachment hearing of Kericho Governor Erick Mutai.
Ronald Kibet, George Muiruri, and Christopher Kimiti contend that the Senate does not have the jurisdiction to hear and rule on the impeachment motion, as it did not receive the necessary support from at least two-thirds of the County Assembly of Kericho members.
They argue, “The Speaker of the County Assembly of Kericho was misinformed in interpreting that the 31 votes in favor of the impeachment motion constituted two-thirds of the 47 assembly members.”
The petitioners claim that the Speaker acted beyond his authority and in disregard of the law by formally communicating a resolution that failed to meet the legally required threshold.
They assert that the Senate lacks the jurisdiction to adjudicate the impeachment motion based on these grounds.
As the legal proceedings unfold, the Senate is currently in the process of hearing the impeachment motion.
This motion has been filed by Sigowet Ward MCA Kiprotich Rogony, who and other MCAs have accused Governor Mutai of serious constitutional violations, abuse of office, and the misuse of public resources.
The outcome of this legal battle could have significant implications for the ongoing impeachment process, as both sides await the Senate’s determination on the matter.
