President William Ruto is poised to approve the Affordable Housing Bill today, Tuesday, March 19, 2024, marking a significant step towards reinstating housing levy deductions.
Originally scheduled for Monday morning, the signing ceremony was rescheduled to Tuesday, as announced by the State House.
Both the Senate and the National Assembly ratified the bill last week, incorporating amendments that involve the inclusion of county governments in its provisions.
The legislation aims to enforce a 1.5% monthly contribution from all Kenyans, irrespective of their employment status, to the Affordable Housing Fund.
The collection of this levy has been the focal point of contention, drawing scrutiny from various quarters including the government, the judiciary, and the public, who have raised concerns about its legal validity.
A judicial ruling in 2023 halted the levy’s collection, citing concerns of discrimination and a violation of Article 10 of the Kenyan constitution.
Before this development, governors had voiced objections during public consultations, questioning why the national government was spearheading the housing initiative when housing falls under the purview of devolved functions.
Under the new legislation, governors will establish county liaison committees tasked with overseeing the rollout of the housing program.
