A group of six judges, whose appointments were declined by former President Uhuru Kenyatta, has taken legal action by filing a court case with the aim of receiving compensation and an apology from the government.
These judicial officers, led by Justice Aggrey Muchelule, contend that the government never provided adequate reasons for their non-appointment during the period from July 22, 2019, to September of the following year.
It was only after President William Ruto’s inauguration into office that they were officially appointed.
These six judges assert that they endured significant public embarrassment due to the lack of clarity surrounding their appointments.
Consequently, they are seeking a public apology from the office of the President to restore their reputations, which were tarnished by allegations of incompetence and unsuitability for judicial roles.
In their court documents, the judges state, “We endured considerable public humiliation due to insinuations propagated by Uhuru Kenyatta and other public officials, insinuating that we collectively lacked the qualifications to hold judicial positions in Kenya.”
The group of judges includes Court of Appeal justices Korir Weldon Kipyegon, Muchelule Aggrey Otsyula, Odunga George Vincent, and Prof. Joel Mwaura Ngugi, each pursuing compensation of Ksh.3.9 million from the government.
Additionally, the two judges from the environment court, Makori Evans Kiago and Cheruiyot Omange Judith Elizabeth, are each seeking Ksh.3.7 million.
Collectively, the sought compensation amounts to Ksh.23 million, reflecting the judges’ determination to address the impact of their rejected appointments.
