The Music Copyright Society of Kenya (MCSK) has suspended its Chief Executive Officer (CEO), Dr. Ezekiel Mutua, effective immediately.
The suspension was announced in a public notice released by the MCSK Board of Directors on Saturday, November 23, 2024.
According to the notice, Mutua is no longer authorized to conduct business on behalf of the organization, and MCSK will not be held responsible for any agreements made by him during this period.
The Board’s statement emphasized that Mutua’s suspension follows a series of legal actions, including court orders issued by Justice Chigiti (S.C) in August 2024, which allowed the newly elected MCSK Board to take office.
However, those orders were later vacated on November 20, 2024, after the court determined it lacked jurisdiction to issue them.
Pamela Binale, the Chairperson of MCSK, further explained that the Board’s decision was also based on a request from the Attorney General’s office and a letter sent to Mutua on August 16, 2024, asking him to show cause why disciplinary measures should not be taken against him for certain issues.
Despite this request, Mutua had not responded, prompting the Board to take action.
Mutua has been given until 8:00 AM on Tuesday, November 26, 2024, to respond to the allegations, failing which the Board will proceed with determining appropriate disciplinary measures.
The suspension comes after accusations of financial mismanagement within MCSK.
In February 2024, renowned rapper Nonini publicly criticized the society’s handling of funds, claiming that MCSK’s directors were benefiting disproportionately from collections meant for artists.
Nonini pointed out that in 2023, only sh 10.5 million of the sh 109 million collected by MCSK was distributed to artists.
Mutua denied the claims, instead accusing Nonini of embezzling funds during his time as a director at other music organizations.
The ongoing developments at MCSK have raised concerns within the music industry about the transparency and management of funds intended for artists.
