Former Citizen TV news anchor was acquitted of killing Monica Kimani while Joseph Irungu alias Jowie was convicted of killing Monica Kimani on the night of September 19, 2018.
While convicting Jowie, Justice Grace Nzioka noted that the prosecution had proved beyond reasonable doubt that Jowie committed that offense
“It was not a case of excusable homicide it was unlawful.
I find Jowie guilty as charged here in the offense of murder”
While acquitting Jackie Maribe, the court noted that the charge brought against her was not the proper charge.
Justice Nzioka noted that the evidence brought in court relating to the second accused person only related to the shooting event that took place on September 20, 2018.
“Having considered the provision of section 129 of the penal code (offense of giving false information to a person employed in public service).”
“And Maribe having no objection to the two statements she gave to the police.
The statement Maribe gave to police was false and given to a person in public service,” the court ruled
Maribe through her lawyer Katwa Kigen thanked the court for the attention to detail it gave for both factual and legal
“We want to say we are sorry to Jowie we are grateful for the acquittal,” Kigen told the court.
However, the prosecution asked the court to remand Jowie to Nairobi remand pending a pre-sentence report.
On his part, Jowie through his lawyer asked Justice Nzioka to maintain his bail terms.
“He is not a flight risk, he will avail himself for mitigation when required by court.”
Justice Nzioka however cancelled his bond and directed that he be held in custody
“Unfortunately after conviction, I’m unable to allow the prayer requested by your counsel for you to remain on bond” ruled Justice Nzioka
The matter will be mentioned on March 8 for mitigation and sentencing purposes.
