The Ethics and Anti-Corruption Commission (EACC) and the Office of the Director of Public Prosecutions (ODPP) are currently engaged in a heated dispute, raising doubts about the effectiveness of the fight against corruption.
EACC has contested ODPP’s decision to withdraw charges in a corruption case involving three former Geothermal Development Company officials.
The anti-graft agency argues that ODPP’s move lacks consideration for the public interest or the pursuit of justice.

According to EACC, the three ex-employees of the geothermal company are facing trial for inflating the cost of Rig Move services by more than 100%.
The commission’s investigation revealed that they unlawfully obtained services worth Sh.42,747,000, significantly higher than the previous year’s cost of Sh.19,550,000, indicating an unjustifiable increase.
However, ODPP asserts that upon reevaluation, there was insufficient evidence to support the allegation of overpricing.
They cite the first accused, Nicholas Karume Weke’s request for a review, leading to the decision to withdraw the case.
The matter has reached the High Court, with both EACC and ODPP jointly pursuing the case against the accused, following instructions from the Supreme Court to prioritize the hearing.
EACC opposes ODPP’s motion to drop charges, arguing that it does not serve the public interest or uphold justice.
The legal proceedings have been adjourned to allow time for the defense and ODPP to respond to EACC’s affidavit.
This clash between EACC and ODPP marks the second instance of disagreement within a short span.
Previously, they were in court over a similar application by ODPP to dismiss charges in a Sh.30 million corruption case involving the former Kenya Pipeline MD and two others.
