Homa Bay Town MP Peter Kaluma has threatened to sue over the republication of a viral video showing a heated exchange between him and Suba North MP Millie Odhiambo.
The clip, which has resurfaced online, was recorded during a parliamentary debate on the Assisted Reproductive Technology Bill. In the video, Kaluma is heard telling Odhiambo, “Nobody stops you from getting children, even now,” after she raised concerns about delays in passing the legislation.
In a statement on Friday, August 28, Kaluma said the video was being circulated without the context of the parliamentary debate, creating what he described as a misleading impression of the exchange.
Kaluma explained that the debate took place the previous year as Parliament considered legislation on assisted reproductive technology, including provisions on surrogacy for people unable to conceive naturally.
He said he had proposed several amendments to the Bill, all of which were subsequently approved by Parliament.
According to Kaluma, Odhiambo had argued during the debate that his proposed amendments were delaying her ability to have a child through surrogacy.
He said he responded by maintaining that Parliament had a responsibility to enact laws that would serve future generations and should therefore reject provisions it considered inappropriate.
Kaluma further stated that surrogacy was not prohibited in Kenya at the time and that Odhiambo could pursue the option even while Parliament was debating the Bill.
He said he had cited former MP Shabir as an example of someone who had reportedly had children through surrogacy while the legislation was still under consideration.
The Homa Bay MP accused individuals circulating the clip of deliberately stripping it of its parliamentary context and portraying the exchange in a defamatory manner.

He argued that republishing footage from more than a year ago without explaining the circumstances surrounding the debate had harmed his reputation.
Kaluma has therefore demanded the removal or retraction of the video and an apology from those who republished it.
He warned that failure to comply would prompt him to pursue legal action for defamation.
The dispute comes weeks after Mount Elgon MP Fred Kapondi also threatened legal action against former Deputy President Rigathi Gachagua over allegations linking him to the killing of former councillor Nathan Wasama.
Wasama, 61, was shot dead on Saturday night, August 8, at his shop in Tuikut Trading Centre, Cheptais, Bungoma County.
Gachagua later claimed that security officers had searched Kapondi’s residence and recovered 18 firearms and more than 3,000 rounds of ammunition after he publicly raised concerns about the killing.
Kapondi denied the allegations and challenged Gachagua to produce evidence supporting the claims, saying he would take legal action over the accusations.
He also questioned why investigators had not publicly responded to Gachagua’s claims if the allegations concerning the firearms were untrue.
