Today, a man appeared in Milimani Law Court in Nairobi for allegedly sharing someone’s personal information without permission.
According to court documents, Hatim Mohamed Tahir and another person are accused of giving personal data to lawyer Lynn Nganga, who is handling a civil case.
This happened on September 19, 2023, at Gigiri Court Yard in Westlands, Nairobi. The information belonged to Rose Friedman and a child.
During the court session, Hatim’s lawyer, Duncan Okatch, asked the judge to stop the media from reporting on the case because it could embarrass his client.
The judge told Hatim to formally ask for this media ban.
The case will be mentioned again on July 29.
The court will decide when the trial will start and whether to stop the media from covering it.
The Directorate of Criminal Investigations (DCI) needs two more weeks to give evidence about the case.
Hatim Mohamed Tahir paid sh.100,000 for bail and Magistrate R.M. Ndombi is handling the case.
The person who says their data was shared has hired Feisal Wakil to help with the case.
In a letter, she said, “I’ve asked Felix Otieno and Co. Advocates to be my lawyers.”
Sections 72(b) and 73 of Kenya’s Data Protection Act (2018) tell how to protect personal information.
They say what people’s rights are with their data and what people who use data have to do.
