A judge has allowed prosecutors to drop murder charges against Tob Cohen’s widow Sarah Wairimu Kamotho.
Sarah had been charged with the murder of her late husband.
Justice Daniel Ogembo Tuesday allowed the application for withdrawal that was made by the Office of the Directorate of Public Prosecutions and discharged Sarah and her co-accused Peter Karanja.
Ogembo said he was not convinced by the victim’s objections to the withdrawal application that was made by the DPP.
Cohen’s sister Gabriele Van Straten had opposed the withdrawal of the case saying the family who are victims were not informed by the ODPP that he was going to drop the case.
The court said the ODPP is an independent office and does not need anyone’s permission to discharge its mandate including charging and discharging.
The judge also said that in this case by discharging the two accused did not mean they are off the hook because the case is going to an inquest so the accused could still be charged with the offense.
