Alex Maina Ochogo, his mother Pacifica Nyakerario and Rael Nyakerario appeared before Senior Resident Magistrate Christine Ogweno Thursday, December 22 following the conclusion of investigations by the investigation officers.
Prosecutor Hilary Kaino however told the court they will not proceed to charge the suspects following the absence of interested parties like the children’s officers and the Law Society of Kenya.
“We request to detain the suspects for one more day for the interested parties to be present during the plea taking,” said Kaino.
The magistrate agreed to have the three detained for a day saying, considering the magnitude of the matter, the suspects will take a plea in the presence of interested parties.
“Considering the nature of this case which has attracted huge public interest the suspects will be detained at Rioma police station till tomorrow morning for them to face the charges,” said Ogweno.

This was after the child was discharged from the hospital he has been for more than a week.
