MCA In Thika Fatal Shooting Charged With Publishing False information, Released On Sh100,000


A Kiambu Member of County Assembly involved in the fatal shooting of a trader in Thika was Monday charged with four counts.

The Kamenu Ward MCA Peter Mburu Mungai and Patrick Ng’anga Mungai were arraigned at Milimani law courts to face four charges against them relating to conspiracy to commit a felony contrary to Section 293 of the Penal Code.

The charges stated that between May 10 and 17, 2024 at an unknown place within the Republic of Kenya, jointly with others not before court, they conspired to publish false information that land parcel number Thika Municipality Block 30/1825 in Kiganjo within Kamenu Ward was a county government land, knowingly or ought to have known that the parcel of land belonged to Kiganjo Location Ranching Company Limited and it had been handed over to the National Government for construction of Kiganjo Kimuchu Modern Market.

Additionally, Patrick Nga’nga Mungai was charged with publication of false information, contrary to Section 22(2)(1) of Computer Misuse and Cybercrime Act No. 5 of 2018.

It is alleged that on diverse days at an unknown place within Kenya, he published false information using his mobile number via a WhatsApp group, Ngoliba Ward Latest, knowingly or ought to have known that such publication was false and likely to incite violence.

The two denied all the four charges against them and were released on a Sh600, 000 bond and surety of the same amount or an alternative cash bail of Sh200,000 with two contact persons.

The case is slated for pre-trial on June 19 2024.

He was arrested alongside Gatundu South MP GG Kagombe who is set to face murder charges.

This is in relation to a shooting incident where a man died and another was injured.

Lawlessness reigned in Thika Town on May 17, when supporters of the area MP Alice Ng’ang’a and those of Mburu clashed.

The MPs had been at a different event in the area when they decided to accompany their colleague Nganga to the proposed market site.

They however found the MCA at the site with a group of locals who had already subdivided the parcel of land in anticipation of ownership of market spaces.

This sparked violent clash with bullets fired.

MCA Mburu had a day earlier visited the contested market area and subdivided it into stalls and a bulldozer began clearing the site.

MP Ng’ang’a showed up a day later with a bulldozer accompanied by National Assembly Majority Leader Kimani Ichung’wah.

MP Alice Ng’ang’a had led other MPs including Ichung’wa (Kikuyu), Kagombe (Gatundu South), Njoroge (Gatundu North) and Ngoliba Ward MCA Joachim Njama in launching the market.

Kagombe was captured on video shooting to the air.

Kagombe blamed the local governor for the chaos.

The MCA said Kiambu Governor Kimani Wamatangi had set aside Sh50 million for the Kamenu market.

He accused the area MP of meddling in county projects.
