Attorney General Justine Muturi has advised the Treasury to release NG-CDF funds.
Treasury Cabinet Secretary Prof. Njuguna Ndungu on Thursday wrote to the Speaker informing the House he had received a green light from the AG to release the monies.
Treasury will now release Sh2 billion to constituencies every week beginning Friday next week.
This means the MPs finally have their way on the CDF issue.
This brings to end months of stalemate following a court ruling that outlawed the CDF Act 2013.
The CS had sought the AG’s opinion on the implication of the ruling that declared CDF unconstitutional.
In his legal opinion to the Treasury, Muturi said the NG-CDF technically remains in force until a contrary direction is made by a superior court.
The ruling, he noted, does not affect the NG-CDF Act 2015 under which the Fund currently operates.
“Treasury confirms it will commence disbursement from Sh2 billion every week starting December 9,” National Assembly Speaker Moses Wetangula said in his communication to the House on Thursday afternoon amid applause from the MPs present.
