Court Declines To Give Orders To CCTV Service Providers At Matiang’i’s Home To Produce Footage In Alleged Raid

The Court has declined to grant orders to the DCI to obtain footage from bob Morgan security relating to Former CS Fred Matiangi’s home raid.

Magistrate Wandia Nyamu instead directed them to file and serve and appear in court on March 7.

DCI wanted Amsec Security Services Limited, the providers of the Closed-Circuit Television (CCTV) services to Matiang’i’s home to produce footage captured during the alleged scene of the home raid.

The police wanted the CCTV service providers to provide the footage for the period between February 8, from 6 and 11 am on February 9, 2023, to Eunice Njue, a police officer investigator.

“… Issue an order compelling the manager of Amsec Security Services Limited, in person or through a nominee, to extract and avail to Eunice Njue, a police officer and investigator attached to County DCI Headquarters Nairobi, with the footages for the period between February 8, from 6 and 11 am on February 9, 2023, captured by Closed-Circuit Television installed and or controlled by the respondent at the residence of Hon. Dr. Fred Matiang’I, the former cabinet secretary and National Security,” the police sought.

The police wanted the CCTV service providers to provide a certificate of production of electronic evidence to County DCI

Headquarters under Section 106B(4) of the Evidence Act in respect of CCTV footage.

On February 8 in the evening Matiang’i said his home was under siege.

His lawyers said the police had surrounded his compound and intended to arrest him.

The next day the former CS sought conservatory orders, which he was granted by the court.

The DCI denied the claims that the police were sent to Matiang’i’s home as they probed the incident.
