The Director of Public Prosecutions (DPP) has approved murder charges against five suspects accused of killing lawyer Mathew Kyalo Mbobu.
The suspects are politician Rose Mbithe Mulwa, her two children, Chris Mulwa and Angela Mulwa, and two police constables, Julius Kipkoech Cheruiyot and Kennedy Kipkemei Borboroi.
Cheruiyot and Borboroi were Thursday arraigned before Justice Diana Kavedza at the High Court in Kibera but did not take a plea.
The court directed that they undergo a mental assessment at Mbagathi Hospital. Justice Kavedza also directed the production of Mbithe and Mulwa, who are remanded at Lang’ata Women’s Prison, and Mulwa who is at Nairobi Remand and Allocation Prison.
The three are separately charged with the murder of Dr. Victoria Mutiso.
The five suspects are scheduled to take plea on October 27, 2026, after the court receives the mental assessment report.
Mbobu, a renowned lawyer, university lecturer and author, was allegedly attacked and killed on September 9, 2025 in Nairobi.
Mbobu had represented Dr Mutiso’s husband, Prof David Ndetei, in legal proceedings.
Dr. Mutiso, a former Director of the African Institute of Mental and Brain Health, was fatally shot on July 29, 2026, in Upper Hill, Kilimani Sub-County, Nairobi, while inside a motor vehicle.
The DCI has also identified a land dispute involving Dr. Mutiso as a possible motive for the killing. Investigators said the deceased was involved in a dispute over L.R. Number 1504/13, which is the subject of a case before the Machakos court.
Detectives had established that Inspector Kenneth Sang, who is currently at large, allegedly coordinated the operation in liaison with Mbithe, who is already in police custody in connection with the murder of Dr. Mutiso, who was fatally shot on July 29, 2026 in Upper Hill, Nairobi.
