Nairobi lawyer Harrison Kinyanjui now wants the Directorate of Criminal Investigations (DCI) to probe businessman Michael Mutembei Makarina Kibutha over a social media post he claims falsely linked him to a Sh25.4 million bribery scandal involving the Supreme Court.
In a complaint dated August 17, Kinyanjui accuses Makarina of publishing a video on his X account alleging that the Ethics and Anti-Corruption Commission (EACC) had arrested a judge and a lawyer linked to former Deputy President Rigathi Gachagua over a bribery scheme.
Kinyanjui said the post identified him as the lawyer allegedly arrested over the Sh25.4 million bribe to influence Supreme Court cases.
The lawyer has denied ever being arrested or charged with any bribery offence, describing the allegations as false and malicious.
He said the publication has damaged his reputation and caused him distress after 25 years of practising law.
Kinyanjui has also invoked Section 27(1) of the Computer Misuse and Cybercrimes Act, 2018, in asking the DCI to investigate the publication.
He claimed he contacted Makarina and asked him to remove the post, but the businessman declined.
The complaint comes after Kinyanjui, through his lawyers, demanded Sh50 million from Makarina over the alleged defamatory publication and sought its retraction.
Meanwhile, the EACC has distanced itself from the claims, saying it did not conduct any operation to arrest a High Court advocate or other prominent individuals over an alleged bribery scheme.
The commission described the circulating reports as false and misleading and urged the public to disregard them.
