Makadara Court Detains Man Charged With Intimidation Pending Bail Ruling


A Makadara court Thursday ordered the detention of a man accused of threatening to kill a complainant in an ongoing criminal case, pending a ruling on his bail and bond application.

Ahmed Ali Mohammed was arraigned before Makadara Senior Principal Magistrate Gilbert Shikwe on Thursday and charged with intimidation contrary to Section 238 of the Penal Code.

According to court documents, Mohammed allegedly threatened the complainant on July 11, 2025, at an AS Petrol Station in the Pumwani area of Kamukunji Sub-county.

Prosecutors told the court that he uttered the words, “Toa hio kesi kotini or I will kill you,” in an attempt to compel the complainant to withdraw a pending case of obtaining by false pretences before the Makadara Law Courts.

The prosecution maintains that the accused had no lawful justification for making the threat and intended to instill fear and apprehension of harm in the complainant.

Mohammed denied the charge when he appeared before the court, prompting the magistrate to enter a plea of not guilty.

His defence team urged the court to release him on reasonable bail and bond terms pending the hearing and determination of the case.

However, the prosecution opposed the application, arguing that the accused had already demonstrated a willingness to interfere with the administration of justice by allegedly intimidating the complainant over a pending matter.

“This is a very serious offence, taking into consideration that despite being released on cash bail, the accused person has proceeded to intimidate the complainant to withdraw the pending case, whose threat jeopardises the safety of the complainant,” the prosecution submitted.

The prosecution further argued that the accused had breached judicial bail and bond guidelines, which prohibit interference with witnesses, and that this outweighed his constitutional right to be released on bail.

Magistrate Shikwe directed that Mohammed remain in custody and scheduled a ruling on his bail and bond application for June 15, 2026.
