ODPP Orders Probe Into South C Building Collapse as Police Given 7-Day Deadline


The Office of the Director of Public Prosecutions (ODPP) has directed that investigations be launched into the circumstances surrounding the collapse of a multi-storey building in South C, Nairobi.

In a statement issued on Sunday, January 4, the ODPP said the move is aimed at ensuring accountability for all individuals, whether in the public or private sector, who may have facilitated or overlooked unsafe construction practices.

The ODPP further instructed the Inspector General of Police to move with speed and submit a detailed report within seven days.

“To ensure that every person who enabled the unsafe construction is held to account, the Director of Public Prosecutions has directed the Inspector General of Police to immediately initiate and or fast-track investigations into the circumstances surrounding the incident and submit a comprehensive report to the ODPP within seven (7) days from today,” the statement said.

According to the ODPP, the probe must include the recording of statements from all key persons linked to the project before the file is forwarded for prosecutorial consideration.

“The DPP has directed the IGP to record statements from all relevant persons, including the developer and contractor, as well as those responsible for building approvals, inspections, and enforcement, and to forward the investigation file for review and appropriate action within seven days,” the statement added.

This development comes just days after the National Construction Authority (NCA) issued its own update on the collapse of the building, which was under construction in South C.

In a statement released on Friday, January 2, the NCA confirmed the incident and provided details on the project’s location, registration status, and the parties involved.

“The National Construction Authority confirms the collapse of a multi-storey building under construction in South C, Nairobi, near South C Shopping Centre and Nairobi South Hospital, which occurred in the early hours of Friday, January 2, 2026,” the authority said.

The NCA disclosed that the project was a proposed mixed-use development located on Muhho Avenue, plot number 68/1306, within South C Ward, Lang’ata Sub-county.

The authority also revealed that while the project had been registered with the NCA, it was non-compliant at the time of the collapse. Records show that the developer was Abyan Consulting Limited, which also doubled as the contractor for the project.

Further details identified the consultants involved, including architect Gideon Chege Mwangi, engineer Peter Kimani Kireru, and quantity surveyor James Kirika Njoroge.

The NCA added that the contractor was registered under the NCA 4 category for building works and named Yussuf Mohamed Yussuf as the company’s sole director.

According to the authority, emergency response teams were deployed immediately after the incident, with search-and-rescue and site security operations continuing as investigations proceed.

“Upon receipt of the incident report, emergency teams were promptly dispatched to the site. At the time of issuing this statement, rescue operations and site securing activities were ongoing in coordination with relevant emergency and security agencies. A comprehensive report will be issued once investigations are complete,” the NCA stated.
