Omtatah With 21 Senators Back To Court Challenging Housing Levy Again!


SENATOR Okiya Omutatah and 21 other senators have returned to court to tighten their throats with President William regarding the tax law for the construction of affordable houses which they claim is illegal and that it conflicts with the Constitution.

The senators Okiya Omutatah, Stewart Madzayo, Enock Wambua, Ledama ole Kina, Edward Sifuna, Okong’o Omogen, Kajwang Moses Otieno, Godfrey Osotsi, Mohamed Faki Mwinyi Haji, Johnes Mwaruma, Crystal Asige, Dan Maanzo, Agnes Kavindu Muthama, Oburu Odinga, Richard Onyonka, Beatrice A Oyomo, Catherine Muyeka Mumma, Hamida Kibwana, Hezena Lamaletian, Dr Beth Kalunda Syengo, Shakila Abdalla Mohamed and Eddy Gicheru Oketch are asking the high court to use the power and authority given by Article No. 165 of the Constitution to liberate Kenyans and what they said is “ slavery today”.

In the case scheduled to be urgent by Judge Enock Chacha Mwita, the senators are asking a panel of at least five judges to be appointed to evaluate the entire process of the law on the construction of affordable houses which they say was passed rashly before being censored by the Senate.

The main request is the outlawing of the affordable housing tax law passed by parliament and signed by President William Ruto on March 24, 2024.

The senators have said that this tax oppresses Kenyans and the solution is for the high court to outlaw it.

These politicians have said that the adoption of this new law for the construction of affordable houses has legalized the use of law number 84 of the Financial Laws 2024 which was outlawed by three judges of the high court.
