One of the three men who were captured on CCTV shooting a Greek national on October 15, 2022, was Tuesday detained for 14 days.
Peter Waithaka was presented before Milimani court Chief Magistrate Benard Ochoi on Tuesday, December 13, 2022 where police were granted 14 days to detain him at Capitol hill police station until they complete their investigations before charging him officially.
Police had asked for 21 days.
The suspect was arrested on Friday last week in Makongeni, Kaloleni area of Nairobi where after the arrest he led them to his house in Wangige, Kiambu county.
In their affidavit police said contrary to claims by members of the public that the accused alongside his accomplices was dangerous and armed when he was arrested he was unarmed and even a search in his house no weapon was found in it.
However, police said that the clothes he was wearing and captured in the CCTV footage was found in his house alongside a watch and a ring suspected to have been stolen.
Police added that when he was arrested he identified himself to them as George Njenga while his true name was Peter Waithaka.
In their affidavit police added that after he was arrested some police stations in Nairobi like Langata and Kilimani emerged with reports that the suspect was wanted by them after records in their OB of offenses they committed on various dates.
The suspect had objected to him being held for that long claiming that he was arrested with no evidence in Kaloleni, Makongeni area and that he was sick suffering from high blood pressure and diabetes.
Waithaka claimed that police arrested him with USD 3107 which they refused to give him so that he can hand over to his family and only gave him USD 7 on Monday when he asked for the money.
The Magistrate ordered that the suspect be given an opportunity to access his drugs and that the OCS Capitol hill police station launch investigations on the whereabouts of the money in US dollars that Waithaka claims were his and that police were holding on it.
In the October incident, the jailbird together with two accomplices on a numberless motorbike accosted Alex Marcopaulo, at the Menellik /Ngong road junction and violently took away a rucksack that he was carrying.
One of them then whipped out a pistol and shot Marcopaulo once on the right side of the chest, before taking off on a motorbike.
Efforts by doctors at the Nairobi Women’s hospital to save the victim’s life were fruitless as he later succumbed to the gunshot injury.
In a separate incident on September 29, the armed thugs had accosted four Dutch tourists outside a Silver Harbour apartment along Kindaruma road and violently robbed them of their mobile phones, cash and jewelry before escaping towards Ngong road on a motorbike, whose plate numbers were concealed.
As they made their escape, the thugs fired two shots in the air to scare off members of the public who had responded to the distress call by the besieged tourists.
The Dutch tourists were waiting to board a tour van to Nairobi National Park when the thugs stuck in the 8 am incident.
Since then, detectives have been burning the midnight candle to unmask the identity of the miscreant gang and bring all of them to book.
Earlier, the Kilimani-based sleuths had arrested one of Waithaka’s accomplices identified as Stephen Elavuna, 38, whose case is pending before the Chief Magistrate’s court in Kibera.
An operation to arrest the remaining suspects is currently ongoing, as the detectives follow crucial leads on their whereabouts.
