The Director of Public Prosecutors Wednesday withdrew murder charges against late Tob Cohen widow Sarah Wairimu and her co-accused Peter Karanja.
Prosecutor Wangui Gichuhi told a court they had filed a Nole prosequi in court seeking not to proceed with the matter.
Wangui had told Justice Daniel Ogembo that the matter will now be registered as an inquest.
Deputy director of prosecution Jecinta Nyamosi said this was in line with the powers conferred by Article 157(6)(c) and 157(9) of the Constitution of Kenya as read with Section 5(1)(b)(iil) of the ODPP Act No. 2 of 2019.
“I hereby enter a Nolle Prosequi and inform this Honourable court that the Republie intends that the criminal proceedings against the above named persons who are charged with the offence of Murder contrary to section 203 as read with section 204 of the Penal Code, Laws of Kenya.”
The issue was thorny and controversial for almost two years.
